your rental at “Paulette bike rental”
We draw your attention to the fact that these general rental conditions apply to all rentals except for rentals from partner rental agencies in the Paulette network, chosen based on the quality of equipment offered for rent and their professionalism:La Rochelle, EcoVélo17, www.ecovelo17.com
Royan (La Palmyre), CycloTrott, www.cyclotrott.com
From these agencies, “Paulette bike rental” acts as a booking center for customers, to the exclusion of any other role. The partner rental agency alone assumes responsibility as lessor to customers. The General Rental Conditions from these agencies can be consulted on these partners’ websites (see above) and at their agencies. For reservations from these cities, the booking conditions on the Paulette website as well as the cancellation conditions before departure are identical to those described in these General Rental Conditions.

1. Your responsibility
You are responsible for the consequences to yourself and others of using the bikes and equipment entrusted to you throughout the rental period.
2. Use of rented bikes, equipment and accessories
You accept responsibility when the rented equipment is lost or damaged. Additional charges may be billed if you return the equipment at a time or place other than those specified in the contract or if the equipment is beyond normal wear and tear.
3. Optional warranties
Please read your contract and the General Rental Conditions carefully to fully understand your obligations regarding your use of the equipment and keep in mind that applicable optional warranties may not apply in case of breach of your contractual obligations.

BASIC INFORMATION
The Rental Agreement
Your Rental Agreement is the document you sign when you pick up your rental bikes, equipment and accessories and includes details of your rental (e.g.: duration, selected services and an estimate of charges). By signing this document, you acknowledge that the information it contains is correct and you agree to the General Rental Conditions.
The Rental Agreement is neither assignable nor transferable. Unless previously agreed, it is forbidden to sublease the rented equipment or to offer it as part of a commercial or non-commercial service offered by a commercial or non-commercial entity.
The Rental Agreement is concluded with FAUVEAU LOC VELO SAS, registered with the Perpignan Trade and Companies Register under number 847 813 110. All references to “FAUVEAU LOC VELO”, “FLV”, “PAULETTE”, “we”, “our” and “the lessor” refer to this company.
Definitions
The customer / the renter / you / your: refers to the individual or legal entity signing the contract and legally responsible to the lessor.
Rental period: from the delivery of equipment until the date validated by the contract, possibly modified with the lessor’s agreement
Bikes / equipment / accessories / materials: refers to materials of any nature (bikes with or without electric assistance, trailers and any other equipment or accessory) that are the subject of the rental agreement
Optional / additional services: refers to all service provisions offered by FLV company in addition to bike and equipment rental, including luggage storage and transport, optional warranties, etc.
PAULETTE agencies: refers to all bike and equipment rental locations. They may be operated directly by FLV company or by duly trained correspondents linked to FLV company by a correspondence contract.
PAULETTE drop-off points: refers to locations where bikes and equipment can be returned at the end of the rental to the exclusion of any other service, advice or provision. They are operated by FLV company partners.
Purpose of the contract
The purpose of the contract is to specify the details of the rental of bikes, equipment and accessories entrusted to the customer during the rental period as well as the optional services selected by the customer.
The rental takes effect when the renter takes possession of the equipment delivered to them. The risks will be transferred upon delivery of the equipment to the renter who will assume custody under their full responsibility.
This contract is only valid for the duration of the rental. If the renter keeps the equipment beyond this period without having regularized their situation, they lose the benefit of all warranties provided in the contract.
Responsibility
Our responsibility to you: we are obliged to provide you with equipment in good general condition and good working order, and to ensure its replacement in case of failure not related to inappropriate use. Our contractual liability will be engaged towards you in case of death or bodily injury resulting from our own acts or omissions. However, our liability does not extend to other losses that may arise from your rental, unless these losses are the direct and foreseeable consequence of our negligence or a breach on our part of these General Conditions. In such case, our liability to you will not extend to loss of profits or loss of opportunities that you may suffer
Your responsibility to us: you must maintain, use and return the equipment in accordance with the provisions of the General Conditions.
You accept liability towards us when you return the equipment late, in case of loss or theft of the equipment or damage suffered by it. You also accept liability if you are subject to a fine or payment of fees of any other nature during your rental period.
Please read your Rental Agreement carefully to ensure you fully understand your obligations and responsibilities.
The holder of the Rental Agreement is responsible to the lessor for all other people using the rented equipment and, in particular but not exclusively, for minors.

GDPR and privacy
FLV company complies with all applicable laws and regulations regarding the protection of its customers’ personal data. It is particularly committed to respecting the confidentiality of all its customers’ data.
Disputes
We intend to resolve all disputes amicably and we recommend that you contact PAULETTE Customer Service to report any complaints.
Nevertheless, in accordance with the provisions of Article L211-3 of the Consumer Code, we inform you that you may have recourse to the consumer mediation procedure described in Title I of Book VI of the same Code.
Professional customers
FLV SAS may establish specific contracts with professional customers that may contain special rental conditions that are complementary and/or derogatory to these general rental conditions.
BEFORE THE RENTAL
Conditions to be met in order to rent
The rental agreement can only be signed with an adult holding the contract and responsible to the lessor for all people using the rented equipment, in particular but not exclusively, for minors. They must be able to present all documents necessary for the rental (see paragraph “Necessary documents”).
All users of rented bikes and equipment must be able to ride a bike and must not have any medical contraindications. The lessor reserves the right to assess users’ ability to use a rental bike.
All users of rented bikes and equipment must also have liability insurance.
Booking, cancellation and modification
Booking bikes and equipment is recommended. It can be done on the website www.paulette.bike, by phone with Customer Service or at the counter of one of our agencies.
The booking requires a mandatory prepayment of minimum 20% of the booking amount.
Bookings can be cancelled or modified before the reservation under the following conditions:
Cancellation or modification requests can be made by mail (customer service address: Paulette – Service client – 58 bd des Minimes 31200 Toulouse) or by email (customer service email address: contact@paulette.bike).
Unless previously agreed and in case of customer no-show, bookings will be considered cancelled two hours after the departure time specified in the contract and due in full.
The customer may request from their departure agency or Customer Service a modification of their contract during the rental period and in particular the modification of the location or date of return of all or part of the rented bikes and equipment. FLV company reserves the right to accept or refuse these modifications. Additional fees may be charged to the customer.
PICKING UP BIKES, EQUIPMENT AND ACCESSORIES
Necessary documents
When signing the Rental Agreement, the customer must be able to present the following documents:
Terms of pick-up of bikes, equipment and accessories
Bikes, equipment and accessories will be picked up for rental at PAULETTE agencies and during opening hours communicated on the website. Any pick-up outside agency opening hours or at a different location requires prior agreement from FLV company and may result in additional charges.
The customer is solely responsible for choosing the equipment and accessories (type and size of bikes and other equipment). Certain mandatory or strongly recommended accessories are provided when picking up the bikes: helmet, anti-theft device, puncture repair spray
Depending on their situation, the customer is strongly advised to also use the following equipment and accessories: suitable child transport devices, suitable luggage transport devices, reflective vest if riding on roadways.
Security deposit
When the equipment is made available by the lessor, the renter is asked to pay a security deposit in the form of a bank pre-authorization, the amount of which is set according to the rented equipment and subscribed warranties (see appendix 3). Upon return of the rented equipment without damage, theft or any other amount due by the customer under the Rental Agreement and General Conditions, this security deposit is returned to the renter. The customer hereby agrees that the lessor may charge the amounts due for additional charges from their bank account using the bank pre-authorization.
Presentation of a valid bank card until the end of the rental and allowing for bank pre-authorization is required for any rental. However, the lessor reserves the possibility of accepting the security deposit in the form of a check or cash. In these cases, the lessor may require keeping a valid ID during the rental period.
Regulatory display
Current public rates are visibly displayed in all PAULETTE agencies. These rates may be subject to preferential conditions on the website www.paulette.bike and in each of our agencies depending on seasonality, equipment availability, order characteristics or any other element.
Payment
Any rental requires full and final payment when picking up the bikes, equipment and accessories. Additional payment may be required at the end of the rental in cases of lost, stolen or damaged equipment, rental extension, change of return location or any event generating a financial consequence for the lessor.
Initial condition report of bikes, equipment and accessories
Bikes and certain equipment are subject to a Condition Report, established in the presence of the customer and given to them. The customer acknowledges that this document certifies the condition of the equipment at the start of the rental and that it will be used as a reference to assess the condition of the equipment at the time of return.
Equipment and accessories not subject to a departure condition report are deemed to be in good condition. Any defect or damage other than those resulting from normal wear must be mentioned on the departure condition report of the rented bikes.
Additional services
Depending on the possibilities specific to each agency, the customer may be offered additional services to facilitate the organization of their bike rental and in particular: luggage storage, luggage transport to the bike return location or throughout all stages of their journey.
These services may be performed directly by FLV company or entrusted, under the responsibility of FLV company, to a partner company.
Luggage storage
Paulette offers a luggage storage service, available at most rental locations (the list of agencies offering this service is updated on the website www.paulette.bike). Luggage must meet the following conditions:
The customer must imperatively check the number, general condition, interior and exterior of the luggage at the time of return. Any reservations must be made at the time of luggage return.
The maximum guaranteed value per piece of luggage in case of loss, theft or significant damage is €300 to the exclusion of any other warranty. Do not hesitate to call Customer Service if you have questions about service availability or due to the nature or number of your luggage.
Luggage transport to bike return location
Paulette offers a luggage transport service to the bike return location, available at most rental locations (the list of agencies offering this service is updated on the website www.paulette.bike). The availability of this service is not guaranteed. In the event that this service cannot be provided, the customer will be informed as soon as possible and will have the option to cancel their reservation with a 100% refund even in case of late booking. Luggage must meet the conditions specified in the “Luggage storage” paragraph.
The customer must imperatively check the number, general condition, interior and exterior of the luggage at the time of return. Any reservations must be made at the time of luggage return.
For organizational reasons, this service is only guaranteed for reservations made before 9:00 AM the day before departure. The maximum guaranteed value per piece of luggage in case of loss, theft or significant damage is €300 per piece of luggage to the exclusion of any other warranty. Do not hesitate to call Customer Service if you have questions about service availability or due to the nature or number of your luggage.
Luggage transport throughout all stages of the journey
Paulette offers a daily luggage transport service to your accommodation location, available at most rental locations (the list of agencies offering this service is updated on the website www.paulette.bike). The availability of this service is not guaranteed. In the event that this service cannot be provided, the customer will be informed as soon as possible and will have the option to cancel their reservation with a 100% refund even in case of late booking. Luggage must meet the conditions specified in the “Luggage storage” paragraph.
Luggage delivery is guaranteed before 6:00 PM for each transfer to the location specified in the order. The customer undertakes to inform their successive hosts of the collection and delivery of their luggage by the service provider designated by Paulette
The customer must imperatively check the number, general condition, interior and exterior of the luggage at the time of return. Any reservations must be made at the time of luggage return.
For organizational reasons, this service is only guaranteed for reservations made before 9:00 AM the day before departure. The maximum guaranteed value per piece of luggage in case of loss, theft or significant damage is €300 per piece of luggage to the exclusion of any other warranty. Optional services and warranties
In order to reduce the risks associated with renting PAULETTE bikes and equipment, a set of optional additional services and warranties may be offered:
ZeroDamage warranty
Paulette offers you to subscribe to a ZeroDamage warranty that exempts you from all responsibility regarding the condition of the bikes at the time of their return subject to compliance with bike usage rules.
Theft warranty
Paulette offers you to subscribe to a Theft Warranty that reduces your liability to FAUVEAU LOC VELO SAS by 90% in case of theft of a rented bike with Bicycode-type marking, excluding all other equipment and accessories. The theft warranty is conditional upon filing a complaint with the competent authorities within 48 hours after the theft is discovered, and providing a copy of the complaint within a maximum of five days after filing the complaint. It is reminded that all bikes are subject to numbered marking identified in a national register. FAUVEAU LOC VELO SAS reserves the right to pursue appropriate action in case of unfounded declaration.
Each warranty can only be subscribed for all bikes in the same contract. They relate exclusively to bicycles, pedal-assist bicycles – excluding all other accessories provided free of charge or not for the duration of the rental. Each of these warranties can only be subscribed to, at the latest, when picking up the bikes and equipment in exchange for payment by the customer of a flat fee per bike and equipment and per day of rental. Paulette reserves the right to limit the possibility of subscribing to certain warranties, temporarily or not, in certain agencies or for the entire Paulette network.
DURING THE RENTAL
Your route
The customer is solely responsible for the routes and paths chosen throughout their journey. In particular, the customer is reminded that certain portions of the Canal du Midi towpath are subject to authorization and may be subject to total or partial bicycle traffic bans. Greenways, developed cycle routes do not require authorization to cycle on them.
Equipment usage rules
The customer undertakes to use the equipment with care, to respect all safety and common sense rules particularly for transporting children, transporting and securing luggage, and to take all measures to prevent theft of bikes, equipment and accessories.
It is strictly forbidden to use the bikes in a manifest state of intoxication or under the influence of drugs or medications incompatible with riding a bike.
It is strictly forbidden to modify the equipment or have it repaired by a paid or unpaid service provider without the prior agreement of the lessor.
Special terms (non-exhaustive list):
Failure to comply with these provisions may deprive you of all warranties offered by the lessor including optional warranties and insurance.
Repairs and Assistance during rental
In case of puncture, the customer has a puncture repair spray allowing them to return to the nearest agency. If the problem is more serious (bike breakdown, cable break) the customer will go to the nearest agency which undertakes to provide appropriate assistance including, if necessary, providing a new bike which may be of a different type from the rented bike. Any intervention requiring travel is subject to the lessor’s availability and will be charged at a flat rate, per trip, except for proven responsibility of the lessor: €50 incl. VAT within 20 km of Toulouse, Nantes, Bordeaux and Paris agencies, plus €1.50 incl. VAT per additional kilometer beyond 20 km. In all cases, it is limited to roads open to motor vehicle traffic, with the customer responsible for reaching an accessible road.
RETURN OF BIKES, EQUIPMENT AND ACCESSORIES
Terms of return of bikes, equipment and accessories
Bikes, equipment and accessories must be returned to the agency and at the times specified in the contract. Any modification of the conditions specified in the contract must be subject to prior agreement and may result in additional charges. No price reduction will be granted in case of early return.
Final condition report of bikes, equipment and accessories
Bikes, equipment and accessories are subject to examination to determine the occurrence of damage during the rental period.
Repairs, maintenance and replacement of parts or tires resulting from normal wear are the responsibility of the Lessor. Other repairs, maintenance and replacement of parts or tires are the responsibility of the Renter. The immobilization of rented equipment necessary for its restoration may give rise to payment by the renter of compensation equal to the rental price of the equipment during its immobilization beyond four hours. Repairs made outside the Lessor will not be reimbursed.
The customer may request an update of the Condition Report for returned equipment.
The principles for billing damage to the customer are specified in Appendix 2.
Liability in case of loss or theft
The customer is responsible for rented equipment. In case of equipment theft, the renter must immediately notify the lessor, file a complaint with the competent authorities and provide a photocopy of the complaint.
Subject to any benefit from the Theft warranty subscribed by the customer, the full value of the bike or equipment not returned will be billed to the customer according to the principles specified in Appendix 2.
Information to the lessor upon return
The customer is required to inform the lessor of any event related to the bike rental and in particular:
APPENDIX 1: INFORMATION REGARDING FEES
Any rental agreement gives rise to the collection of a price corresponding to the rental, defined according to the number and type of bikes, equipment and accessories rented, the number of rental days, the pick-up and return locations. Rates depend on the forecast availability of equipment. They are set for each customer at the time of actual equipment booking.

APPENDIX 2: BILLING RATES FOR THEFT/LOSS/DAMAGE TO EQUIPMENT AND ACCESSORIES
Outside the cases covered by the ZeroWorry and ZeroDamage warranties, theft, loss or destruction (i.e. damage not allowing repair under acceptable economic conditions) of bikes, equipment and accessories provided to the customer will be subject to billing equal to the equipment replacement cost evaluated on a flat-rate basis. The flat-rate amount will be determined from the table below:

Equipment not provided for in the General Rental Conditions: the replacement value will be determined from the public price (including tax).
When possible, billing will be limited to the replacement of the damaged part including labor costs to replace the part concerned. The hourly rate taken into account is €35 including tax.
APPENDIX 3: AMOUNT OF SECURITY DEPOSIT REQUIRED WHEN PICKING UP EQUIPMENT
In accordance with the General Rental Conditions, the renter is asked to pay a security deposit in the form of a bank pre-authorization, the amount of which is set according to the rented equipment and subscribed warranties:
