YOUR RENTAL IN A FEW KEY POINTS 

This summary aims to help you better understand what is included in your Rental Agreement, what is excluded, and the available options to optimize your rental. Feel free to approach the agents available at our various agencies if you need further clarifications. 

Some very useful information:

  1.      Your responsibility

You are responsible for the consequences, both for yourself and others, of operating the bicycles and equipment entrusted to you throughout the rental period.

  1.      Use of rented bikes, equipment, and accessories

You assume responsibility when the rented equipment is lost or damaged. Additional charges may apply if you return the equipment at a different time or location than specified in the contract, or if the equipment is in a condition beyond normal wear and tear.

  1.      Optional Guarantees

Carefully read your contract and the General Rental Conditions to fully understand your obligations regarding the use of the equipment, and keep in mind that the applicable optional guarantees may not be applied in case of non-compliance with your contractual obligations.

WHAT IS INCLUDED FOR ALL CONTRACTS

ADDITIONAL REMARKS

LIABILITY INSURANCE

The company is insured for all consequences related to damages you may suffer as a result of our actions (professional liability insurance).

 You are required to have liability insurance that protects you against claims that may be made by third parties following a death, injury, or any material damage related to the operation of the bicycles and equipment entrusted to you.

ASSISTANCE

Basic Assistance is available during the rental period. Any intervention requiring a displacement will be charged unless the responsibility of the rental company is recognized.

You have the option to contact any Paulette agency to provide you with the best advice and, if necessary, replace your bike.

EQUIPMENT

The price you pay includes all mandatory or highly recommended equipment: helmet, lock, first aid kit.

 You can choose additional equipment and services from the range we offer, subject to availability at the respective agencies.

DAMAGE TO BICYCLES AND EQUIPMENT

You are responsible for any damages that may occur to the bicycles and equipment entrusted to you. Damages observed, excluding normal wear and tear, may be charged in addition to the rental price.

 

You can exempt yourself from any liability towards us in the event of damage to the bicycles and equipment entrusted to you by subscribing to a ZeroDamage guarantee.

THEFT OF BICYCLES, EQUIPMENT, AND ACCESSORIES

You are responsible for the bicycles, equipment, and accessories entrusted to you.

 You can protect the rented bicycles and equipment against theft by subscribing to the optional Theft coverage.

 

BASIC INFORMATION 

The Rental Agreement

Your Rental Agreement is the document you sign when you take charge of your rented bicycles, equipment, and accessories, which includes the details of your rental (e.g., duration, selected services, and estimated fees). By signing this document, you acknowledge that the information it contains is accurate and you agree to the General Rental Conditions.

The Rental Agreement is not transferable. Unless agreed upon in advance, it is prohibited to sublet the rented equipment or offer it as part of a commercial or non-commercial service provided by a commercial or non-commercial entity.

The Rental Agreement is entered into with the company FAUVEAU LOC VELO SAS, SIREN 847 813 110 RCS Perpignan. All references to "FAUVEAU LOC VELO," "FLV," "PAULETTE," "we," "us," and "the rental company" refer to this company.

 

Definitions

The client / the renter / you / your: refers to the individual or legal entity signing the contract and legally responsible to the rental company.

Rental period: from the moment the equipment is handed over until the date validated by the contract, which may be modified with the rental company's agreement.

Bicycles / equipment / accessories / materials: refers to all types of equipment (pedal-assisted or non-pedal-assisted cycles, trailers, and any other equipment or accessory) subject to the rental contract.

Optional / additional services: refers to all additional services offered by the FLV company in addition to the rental of bicycles and equipment, including luggage storage and transportation, enhanced assistance service, optional guarantees, etc.

PAULETTE agencies: refers to all bicycle rental points and equipment. They may be directly operated by the FLV company or by correspondents duly trained and linked to the FLV company through a correspondent contract.

PAULETTE drop-off points: refers to the locations where bicycles and equipment can be returned at the end of the rental period, excluding any other service, advice, or provision. They are managed by partners of the FLV company.

 

Contract Object

The contract aims to specify the details of the rental of bicycles, equipment, and accessories entrusted to the client during the rental period, as well as the selected optional services.

The rental becomes effective when the renter takes possession of the delivered equipment. The risks will be transferred upon delivery of the equipment to the renter, who will assume full responsibility for its custody.

This contract is only valid for the duration of the rental. If the renter keeps the equipment beyond this period without regularizing the situation, they will lose the benefit of all guarantees provided in the contract.

 

Responsibility

Our responsibility to you: We are obliged to provide you with equipment in good overall condition and proper working order, and to replace it in case of failure not attributable to improper use. Our contractual liability will be engaged towards you in the event of death or bodily injury resulting from our own actions or omissions. However, our liability does not extend to other losses that may arise from your rental, unless these losses are a direct and foreseeable consequence of our negligence or a breach on our part of these General Rental Conditions. In such a case, our liability to you will not extend to any loss of profits or loss of opportunities you may incur.

Your responsibility to us: You must maintain, use, and return the equipment in accordance with the provisions set forth in the General Rental Conditions.

You are responsible to us if you return the equipment late, if the equipment is lost or stolen, or if it is damaged. You are also responsible if you are fined or required to pay any other fees during the rental period.

Please read your Rental Agreement carefully to ensure that you understand your obligations and responsibilities.

The holder of the Rental Agreement is responsible to the rental company for all other persons using the rented equipment, especially minors.

GDPR and confidentiality

FLV, the company, complies with all applicable laws and regulations regarding the protection of personal data of its customers. It is particularly committed to respecting the confidentiality of all customer data.

 

Disputes

We aim to resolve all disputes amicably, and we recommend that you contact the PAULETTE Customer Service to raise any complaints you may have.

However, in accordance with the provisions of Article L211-3 of the Consumer Code, we inform you that you have the option to use the consumer mediation procedure described in Title I of Book VI of the same Code.

 

Professional Customers

FLV SAS may establish specific contracts with professional customers that may include additional or derogatory rental conditions to these general rental conditions.

 

BEFORE THE RENTAL PERIOD

Conditions to be met for rentings

The rental agreement can only be signed with an adult who is the contract holder and responsible for all individuals using the rented equipment, particularly for minors. They must be able to present all necessary documents for the rental (see paragraph "Required Documents").

All users of the rented bicycles and equipment must be capable of cycling and must not have any medical contraindications. The rental company reserves the right to assess the users' ability to use a rental bicycle.

All users of the rented bicycles and equipment must also have liability insurance.

Reservation, cancellation and modification

Reservation of bicycles and equipment is recommended. It can be made through the website www.paulette.bike, by phone with the Customer Service, or at the counter of one of our agencies.

Reservation requires a mandatory prepayment of at least 20% of the reservation amount.

 

Reservations can be canceled or modified prior to the rental period according to the following conditions:

    • Full refund of all amounts paid up to 48 hours before the start of the rental period.
    • A amount equivalent to 20% of the reservation amount will be retained by FLV in case of cancellation or modification less than 48 hours before the start of the rental period to cover the expenses related to late cancellation.
    • Unless a prior agreement is reached, if the customer does not show up, reservations will be considered canceled two hours after the scheduled departure time specified in the contract.

    During the rental period, the customer can request a modification of the contract, including changes to the location or return date of all or part of the rented bicycles and equipment. FLV reserves the right to accept or decline these modifications. Additional fees may be charged to the customer.

     

    PICK-UP OF BICYCLES, EQUIPMENT, AND ACCESSORIES

    Required Documents

    At the time of signing the rental agreement, the customer must be able to present the following documents:

    • Valid identification document.
    • Credit card used for the reservation, enabling a pre-authorization hold.

     

    Pick-up Procedures for Bicycles, Equipment, and Accessories

    The customer is solely responsible for choosing the equipment and accessories (type and size of bicycles and other equipment). Certain mandatory or highly recommended accessories are provided at the pick-up of bicycles:

    • Helmet
    • Repair kit
    • Anti-theft device
    • Lighting device
    • Horn or bell

    Depending on the customer's situation, the following equipment and accessories are strongly recommended:

    • Suitable child transportation devices
    • Suitable luggage transportation devices
    • Enhanced lighting for prolonged low visibility
    • Reflective vest when cycling on roadways

     

    Security Deposit

    Upon providing the rental equipment, the renter is required to provide a security deposit in the form of a pre-authorization hold, the amount of which is determined based on the rented equipment and the chosen insurance coverage (see Annex 3). Upon the return of the rented equipment without any damage, theft, or outstanding amount owed by the customer according to the rental agreement and the General Terms and Conditions, the security deposit is refunded to the renter. The customer agrees in advance that the rental company may deduct any amounts due for additional expenses from their bank account using the pre-authorization hold.

    A valid credit card that allows a pre-authorization hold until the end of the rental period is required for all rentals. However, the rental company reserves the right to accept the security deposit in the form of a check or cash. In such cases, the rental company may require retaining a valid identification document for the duration of the rental.

     

    Regulatory Dispay

    The current public rates are visibly displayed in all PAULETTE agencies. These rates may be subject to preferential conditions on the website www.paulette.bike based on seasonality, equipment availability, order characteristics, or any other factors.

     

    Payment

    Full and final payment is required at the time of pick-up for bicycles, equipment, and accessories. Additional payment may be required at the end of the rental period in cases of lost, stolen, or damaged equipment, rental extension, change of return location, or any event resulting in financial consequences for the rental company.

     

    Initial inventory of bicycles, equipment, accessories

    Bicycles and certain equipment are subject to an inventory checklist prepared in the presence of the customer and provided to them. The customer acknowledges that this document verifies the condition of the equipment at the start of the rental and will be used as a reference to assess the condition of the equipment upon its return.

    Equipment and accessories that are not subject to an initial inventory checklist are considered to be in good condition. Any defects or damages other than those resulting from normal wear and tear must be noted on the departure inventory checklist for the rented bicycles.

    Additional Services

    Depending on the possibilities at each agency, additional services may be offered to customers to facilitate their bicycle rental, including:

    • Luggage storage
    • Transportation of luggage to the bicycle return location
    • Luggage transportation throughout the stages of the customer's route

    These services may be provided directly by FLV or entrusted, under the responsibility of FLV, to a partner company.

    BagGage sTORAGE

    Paulette offers a baggage storage service, available at most rental locations (the list of agencies offering this service is updated on the website www.paulette.bike). The baggage must comply with the following conditions:

    • No individual items outside of the baggage are allowed.
    • The baggage must be securely closed and preferably locked.
    • No fragile, valuable, or collectible items are allowed.
    • No flammable, explosive, or any products that may pose a risk during storage or handling of the baggage are allowed.
    • No medication, drugs, or any products whose possession is illegal or requires specific authorization are allowed.
    • The maximum weight and size for each baggage are 20 kg and 1.20 meters in length, respectively.

    The customer must thoroughly check the number and general condition, both inside and outside, of the baggage upon return. Any concerns or reservations should be reported at the time of baggage return.

    The maximum guaranteed value per baggage in case of loss, theft, or significant damage is €300, excluding any other warranties. Please feel free to contact Customer Service if you have any questions regarding the availability of the service or due to the nature or number of your baggage.

     

    bagGages TransportATION TO THE BIKE RETURN LOCATION

    Paulette offers a baggage transportation service to the bike return location, available at most rental sites (the list of agencies offering this service is updated on the website www.paulette.bike). The baggage must comply with the conditions specified in the "Baggage Storage" paragraph.

    The customer must thoroughly check the number and general condition, both inside and outside, of the baggage upon return. Any concerns or reservations should be reported at the time of baggage return.

    For organizational reasons, this service is guaranteed only for reservations made before 9:00 AM on the day prior to departure. The maximum guaranteed value per baggage in case of loss, theft, or significant damage is €300 per baggage, excluding any other warranties. Please feel free to contact Customer Service if you have any questions regarding the availability of the service or due to the nature or number of your baggage.

    BAGGAGES TRANSPORTATION FOR THE ENTIRE ROUTE

    Paulette offers a daily baggage transportation service to your accommodation location, available at most rental sites (the list of agencies offering this service is updated on the website www.paulette.bike). The baggage must comply with the conditions specified in the "Baggage Storage" paragraph.

    The delivery of baggage is guaranteed before 6:00 PM for each transfer to the designated location as per the reservation. The customer agrees to inform their successive accommodations about the receipt and delivery of their baggage by Bagafrance, Paulette's service provider.

    The customer must thoroughly check the number and general condition, both inside and outside, of the baggage upon return. Any concerns or reservations should be reported at the time of baggage return.

    For organizational reasons, this service is guaranteed only for reservations made before 9:00 AM on the day prior to departure. The maximum guaranteed value per baggage in case of loss, theft, or significant damage is €300 per baggage, excluding any other warranties. Please feel free to contact Customer Service if you have any questions regarding the availability of the service or due to the nature or number of your baggage.

     

    Optional Services and Guarantees 

    In order to reduce the risks associated with the rental of PAULETTE bikes and equipment, a range of optional additional services and guarantees may be offered:

    • ZeroDamage Guarantee: eliminates the financial consequences related to damages incurred to the rented equipment.
    • Theft Guarantee: eliminates the financial consequences related to the theft of bikes and main rented equipment, excluding a deductible of 10% of the equipment value (see Appendix 2).

    ZEroDAMage GUARANTEE

    Paulette offers you the option to subscribe to a ZeroDamage Guarantee, which relieves you of any liability regarding the condition of the bikes at the time of their return, subject to compliance with the equipment usage rules.

     

    THEFT GUARANTEE

    Paulette offers you the option to subscribe to a Theft Guarantee, which reduces your liability towards FAUVEAU LOC VELO SAS by 90% in the event of theft of a rented bike that has been marked with a Bicycode, excluding all other equipment and accessories. The Theft Guarantee is subject to filing a complaint with the appropriate authorities within 48 hours of the theft being discovered, and providing a copy of the complaint within a maximum of five days after filing. Please note that all bikes are marked with a unique identification number and registered in a national directory. FAUVEAU LOC VELO SAS reserves the right to take appropriate action in the event of a false claim.

     

    Each of the two aforementioned guarantees can only be subscribed to for all bikes and equipment under a single contract. They exclusively cover bicycles, electric-assist bicycles, and, except for the Theft Guarantee, equipment listed on an individualized condition sheet such as luggage trailers, child trailers, and tag-alongs, excluding all other accessories provided, whether free or for a rental period. Each guarantee can only be subscribed to at the latest at the time of picking up the bikes and equipment, upon payment of a fixed amount per bike and equipment per rental day by the customer.

     

    DURING THE RENTAL PERIOD

    Rules for Equipment Usage

    The customer agrees to use the equipment with care, to comply with all safety rules and common sense practices, especially when transporting children and securing luggage, and to take all necessary measures to prevent theft of bikes, equipment, and accessories.

    It is strictly prohibited to use the bikes while visibly intoxicated or under the influence of drugs or medications that impair cycling ability.

    Modifying the equipment or having it repaired by a paid or unpaid service provider without prior authorization from the rental company is strictly prohibited.

    Specific Guidelines:

    • No passenger outside of approved child-carrying devices.
    • Child seat: for ages 1 to 5 weighing between 8 and 20 kg.
    • Child trailer: maximum of 2 children aged 2 to 6, with a combined weight below 35 kg.
    • Rear rack and panniers: non-bulky items with a maximum total weight of 22 kg.
    • Luggage trailer: maximum weight below 30 kg.
    • It is strictly prohibited to transport animals on the bikes or in the trailers.

    Failure to comply with these provisions may result in the loss of all warranties offered by the rental company, including optional guarantees and insurances.

    For your safety and harmonious coexistence with other users of the highway rest area, cycling on the roads of the Port-Lauragais rest area is prohibited. Only the road leading to the port and then to the departmental road is authorized.

     

    Repairs and Assistance during the Rental Period

    In the event of a mechanical problem or puncture, the customer has a repair kit. If the problem is more significant (bike breakage, cable rupture), the customer should contact the rental company (departure agency or Customer Service), which undertakes to provide appropriate assistance, including, if necessary, a replacement bike that may be of a different type than the rented bike. This assistance is available at all Paulette network agencies.

    Any intervention requiring a visit from the rental company is subject to availability and will be charged a fixed fee per visit, unless the rental company is proven to be at fault: €30 including taxes within 20 km of the Toulouse agency (58 bd des Minimes), plus €1.50 including taxes per additional kilometer beyond 20 km.

    In all cases, assistance is limited to roads open to motor vehicle traffic, and it is the customer's responsibility to reach an accessible road.

    BIKE, EQUIPMENTn AND ACCESSORIES RETURN

    Modalities for Returning Bikes Equipment and Accessories 

    The bikes, equipment, and accessories must be returned to the agency and within the specified hours stated in the contract. Any modifications to the agreed-upon conditions in the contract must receive prior approval and may result in additional charges. No price reduction will be granted for early returns.

    If it is impossible to return the bikes during the agency's opening hours and with the prior and express agreement of the rental company, you may return the equipment outside of the agency's opening hours. In such cases, you must securely lock the equipment and park it in a safe location nearby. You remain responsible for the equipment until it is effectively retrieved within two hours after the agency opens. The accessories provided with the bike (helmet, repair kit, etc.) must be returned in person to the agency on the next business day following the end of the rental period. You agree to accept the final inspection conducted by Paulette upon the actual retrieval of the equipment.

     

    Final inspection of Bikes, Equipment and Accessories

    The bikes, equipment, and accessories undergo an examination to determine any damages that may have occurred during the rental period.

    Repairs, maintenance, and replacement of parts or tires resulting from normal wear and tear are the responsibility of the Rental Company. Other repairs, maintenance, and replacement of parts or tires are the responsibility of the Renter. If the rented equipment requires immobilization for repairs beyond four hours, the Renter may be charged an indemnity equal to the rental price of the equipment during the immobilization period. Repairs carried out by third parties will not be reimbursed.

    The customer may request an update to the Equipment Condition Form upon returning the equipment.

    The principles of billing the customer for damages are specified in appendix 2.

     

    Responsibility in case of loss or theft

    The customer is responsible for the rented equipment. In the event of theft, the Renter must immediately notify the Rental Company, file a report with the appropriate authorities, and provide a photocopy of the report.

    Subject to the potential coverage of the Theft Guarantee subscribed by the customer, the full value of the unreturned bike or equipment will be invoiced to the customer according to the principles specified in appendix 2.

     

    Informations to be provided to the Rental Company upon return

    The customer is obliged to inform the Rental Company of any incidents related to the bike rental, including:

    • Accidents or significant impacts
    • Disputes with third parties related to the use of the rented equipment
    • Any occurrence of even minor damage to the safety helmets

     

    APPENDIX 1 : INFORMATIONS REGARDING FEES

    Every rental contract incurs a price corresponding to the rental, determined based on the number and type of bikes, equipment, and accessories rented, the number of rental days, and the pick-up and return locations. The rates are dependent on the projected availability of the equipment. They are set for each customer at the time of the effective reservation of the equipment.

    The customer has the option to benefit from additional optional services, which require an additional payment:

    • Luggage storage: Amount determined based on the number of bags and the number of storage days.
    • Luggage transport to the bike return location: Amount determined based on the number of bags, the number of storage days, and the pick-up and return locations.
    • Luggage transport throughout the entire route: Amount determined based on the number of bags and the number of stages.

    The customer also has the option to subscribe to optional additional guarantee services:

    • ZéroDommage Guarantee: Amount defined based on the number of bikes and equipment rented and the number of rental days.
    • Theft Guarantee: Amount defined based on the number of bikes and equipment rented and the number of rental days.
    • ZéroSouci Pack: Amount defined based on the number of bikes and equipment rented and the number of rental days.

    Additional fees may be charged to the customer in the following cases (see displayed rate schedule at the agency):

    • Total or partial cancellation of the reservation.
    • Changes to the return location and/or return date by the customer after the equipment has been picked up, unless prior agreement has been reached.
    • Pick-up and/or return outside of business hours or at locations different from those offered on the paulette.bike website (prior agreement required).
    • Lost, stolen, or damaged bikes, equipment, and accessories, except when corresponding guarantees are subscribed to (see appendix 2).
    • Assistance fees in the event of the rental company's travel outside of cases of gratuitousness: Flat rate per travel.

     

    APPENDIX 2 : BILLING RATES FOR THEFT/LOSS/DAMADE TO EQUIPMENT AND ACCESSORIES

    Outside of cases covered by the Vol and ZéroDommage guarantees, the theft, loss, or destruction (i.e., damages that cannot be economically repaired) of bicycles, equipment, and accessories provided to the customer will be invoiced at the flat-rate replacement cost of the equipment. The flat-rate amount will be determined based on the following table:

    Equipment not specified in the General Rental Conditions: The replacement value will be determined based on the non-discounted public price (VAT included), minus 10% to account for possible wear and tear.

    When possible, the billing will be limited to the replacement of the damaged part, including the labor costs associated with replacing the affected part. The hourly rate used is €40 (VAT included).

    APPENDIX 3 : A MOUNT OF DEPOSIT REQUIRED UPON PICKUP OF EQUIPMENT

    In accordance with the General Rental Conditions, the lessee is required to provide a security deposit in the form of a bank pre-authorization. The deposit amount is determined based on the rented equipment and the subscribed guarantees:

    Equipment not specified in the General Rental Conditions: The lessor reserves the right to determine a deposit amount corresponding to the replacement cost of the rented equipment.
